The Law

Claims for work related stress tend to fall into two categories:

  • Bullying and/or Harassment cases resulting in psychiatric illness.
  • Cases involving employees who are overworked resulting in psychiatric illness.

If you case involves issues of bullying or harassment then you may be able to present your claim under the provisions of the Protection from Harassment Act 1997 and this removes the requirement to prove that the employer should have foreseen the possibility of an injury occurring due to their or their employees conduct.

Cases involving allegations of overwork are slightly more difficult and it may be necessary to prove the following:

  • You have suffered a recognised psychiatric condition;
  • That you have placed your employer on notice that unless your employer takes immediate steps to reduce your work load that you would suffer from psychiatric illness or injury.

  • Email exchanges, particularly with line managers or any Human Resources department regarding your workload and the affect this is having on your health;
  • Details of any complaints or grievances made by yourself or other members of staff regarding their workload;
  • Contact information for any supportive witnesses;
  • Staff appraisal forms;
  • Dates of any meetings with your line managers regarding your work load together with a summary of the meeting.

It is extremely important that you notify your employer specifically that your employment is causing you ill health. We would always recommend that you document such complaints in writing.
